Sylvan Source Limited Warranty

Limited Warranty: Subject to the conditions and limitations described below, Sylvan Source, Inc. warrants to the original end-user ("User") that its ultra-clean water system, ("System") when installed, used and maintained in accordance with Sylvan Source specifications and procedures, will be free from defects in materials and workmanship as follows:

For a period of three (3) years from date of purchase: INTERNAL AND EXTERNAL COMPONENTS

Any part found to be defective within the terms of this warranty will be repaired or replaced free of charge (shipping and handling charges may apply), at Sylvan Source's option if User notifies Sylvan Source at the phone number listed below or by facsimile at the FAX number listed below within the applicable warranty period specified above. The notice should identify the product involved (by model and serial number), the approximate date and place of purchase, and the nature of the defect asserted. At its sole discretion, Sylvan Source reserves the right to replace the System with a comparable System of equal or greater value, including refurbished products. Any part that is repaired or replaced under this warranty will be covered by this warranty but only for the originally warranted period.

This "repair or replace" warranty is User's sole remedy with respect to the System This warranty shall not apply to any part damaged by shipping, accident, fire, flood, freezing, Acts of God, abuse, misuse, misapplication, neglect, alteration, installation or operation contrary to printed instructions, or by use of accessories or components which do not meet Sylvan Source specifications, were not specified by Sylvan Source or were not provided as part of a System configuration. The warranty is void and will not apply if the System is altered, modified or repaired by anyone other than Sylvan Source or its licensees or if both a water softener system and 25 micron (or less) sediment filter are not used in conjunction with the Sylvan Source ultra-clean water system where hard water concentrations equal or exceed 1 ppm (0.058 grains) hardness as calcium carbonate (CaCO3).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYLVAN SOURCE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT REQUIRED BY LAW, ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE PERIOD SPECIFIED ABOVE FOR THE PARTS DESCRIBED IN THIS LIMITED WARRANTY.

THE SYSTEM PURCHASED BY USER HAS BEEN CERTIFIED BY THE GOVERNMENTAL AGENCY OR AGENCIES SPECIFIED IN THE ACCOMPANYING OWNER'S MANUAL AS HAVING THE CHARACTERISTICS SET FORTH IN THE ACCOMPANYING PRODUCT DATA SHEET AND THE SYSTEM SHOULD GENERALLY PERFORM TO THOSE CERTIFIED STANDARDS. NOTWITHSTANDING SUCH GOVERNMENTAL CERTIFICATION, SYLVAN SOURCE CANNOT GUARANTEE, AND HEREBY DISCLAIMS ANY GUARANTY, WHETHER EXPRESS OR IMPLIED, THAT THE PURCHASED SYSTEM WILL ENHANCE THE HEALTH OF USER OR ANY THIRD-PARTY OR THAT IT WILL PROTECT USER OR ANY THIRD-PARTY ABSOLUTELY FROM THE HEALTH EFFECTS OF EVERY OR ANY KNOWN OR UNKNOWN DRINKING WATER CONTAMINANT, REGARDLESS OF THE CONTAMINANT CONCENTRATION LEVEL.

SYLVAN SOURCE'S OBLIGATIONS UNDER THIS WARRANTY ARE LIMITED TO REPAIR OR REPLACEMENT OF THE FAILED PARTS OF THE SYSTEM AND SUCH OBLIGATIONS ARE CONDITIONED UPON THE RETURN OF THE DEFECTIVE PART(S) TO SYLVAN SOURCE. SYLVAN SOURCE ASSUMES NO LIABILITY WHATSOEVER, TO USER OR ANY THIRD-PARTY, REGARDLESS OF THE THEORY ON WHICH SUCH LIABILITY MAY BE ASSERTED, FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, GENERAL, OR OTHER DAMAGES, WHETHER FROM CORROSION OR OTHER CAUSES.

User has full responsibility for obtaining necessary licenses, permits and inspections that may be required to install and use the products herein described.

Sylvan Source Inc., reserves the right to make design and product changes and change product specifications at any time without contingent obligations to prospective or current owners of products.

As a manufacturer, Sylvan Source does not know the characteristics of User's water supply. The quality of water supplies may vary over a period of time. User's water usage rate may vary as well. Water characteristics can also change if User's drinking water appliance is moved to a new location. For these reasons, Sylvan Source assumes no liability for the determination of the proper equipment necessary to meet User's specific requirements, and Sylvan Source does not authorize others to assume such obligations for Sylvan Source.

Some states do not allow the exclusion of implied warranties or limitations on how long an implied warranty lasts, so the above limitation may not apply to some Users. Similarly, some states do not allow exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to some Users.
